Mediation is Encouraged

In Texas, mediation is encouraged and generally required. The reasoning behind this is that mediation is less stressful, more amicable, and less expensive than a trial. If considering divorce, the important thing to remember is this: if children are involved, you and your divorcing spouse will be in each other's lives for a considerable time. Mediation offers people a way to reach amicable agreements about child custody, child support, and other issues. This is beneficial to not only the former spouses, but the children as well, because it sets a positive and encouraging example to them.

Property Division

Because Texas is a community property state, anything that was accumulated over the course of the marriage is subject to equitable distribution. The economic contribution of each party will be considered in determining this division. Property and assets that are divided commonly include:

  • Marital home
  • Second home or vacation home
  • Furniture and appliances
  • Jewelry
  • Cars
  • Art
  • Recreational vehicles such as boats, RVs, and motorcycles
  • Stocks, bonds, investment portfolios
  • Bank account
  • Pensions

If you have been married ten years or more, the lower earning spouse may be granted spousal support (alimony) if they have a low earning capacity and few assets to their name. Although alimony is very rare, and brief in duration, there are circumstances where it would nevertheless apply. This issue can also be decided in mediation.
